The Town of Burrillville is asking the state Energy Facility Siting Board to dismiss Invenergy’s application on grounds that the application is incomplete.
The Burrillville Planning Board, the Zoning Board of Review, and building inspector and zoning officer say they’re missing information from Invenergy, which hampered their ability to offer advisory opinions.
The Town of Burrillville has filed a motion to dismiss this application with the state Energy Facility Siting Board.
“Invenergy’s application currently contains no information at all about the proposed water source,” wrote the town’s attorneys. “Under Rhode Island law, it is well settled that, in an administrative forum such as this, due process requires an opportunity to be heard ‘at a meaningful time and in a meaningful manner.’”
A dozen local and state offices have submitted mixed advisory opinions about the proposed power plant in Burrillville.
The departments of environmental management and transportation also indicated Invenergy hasn’t filed several permit applications.
