U.S. Immigration and Customs Enforcement have until next month to report how it’s making sure foreigners married to Americans are not deported illegally. A federal judge in Boston has ruled that the law prohibits deportations in certain cases.
Judge Mark Wolf ruled that ICE cannot deport illegal immigrants married to Americans as they work to become permanent residents, unless they pose a danger to national security or public safety.
Matt Segal, legal director for the American Civil Liberties Union of Massachusetts, explains, “If the government targets them for arrest and removal solely on the fact that they have a prior order of removal they they are violating due process.”
An ICE spokesman said the agency does not comment on active litigation.
